Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Our commitment

Mental Fortitude Therapy, LLC is required by law to maintain the privacy of your protected health information, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.

How we may use and disclose your information without your authorization

  • Treatment. To provide, coordinate, or manage your care, including consultation with other providers involved in your treatment.
  • Payment. To obtain payment for services, including verifying benefits, obtaining authorization, and submitting claims.
  • Health care operations. Quality assessment, professional review, training, licensing, and business management.
  • Required by law. When federal, state, or local law requires disclosure.
  • Abuse or neglect. Reports of suspected abuse or neglect of a child, an elder, or a person with a disability, as required by Ohio law.
  • Serious threat to health or safety. To prevent a serious and imminent threat to you or to an identifiable other person.
  • Judicial and administrative proceedings. In response to a court order, or a subpoena where the requirements of law have been met.
  • Health oversight and public health. To agencies authorized by law to receive such reports.
  • Business associates. To vendors who perform services on our behalf and who are contractually bound to protect your information.

Uses that always require your written authorization

  • Most uses and disclosures of psychotherapy notes.
  • Any use or disclosure for marketing purposes.
  • Any sale of your protected health information.
  • Any other use or disclosure not described in this notice.

You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

Substance use disorder records

If you receive substance use disorder treatment from this practice, those records may also be protected by federal law at 42 CFR Part 2, which is more restrictive than HIPAA. In general, we may not disclose that you are receiving such treatment without your written consent, unless an exception under that regulation applies.

Your rights

  • Access. To inspect and obtain a copy of your record, in an electronic format where readily producible.
  • Amendment. To ask us to correct information you believe is inaccurate or incomplete.
  • Accounting of disclosures. To receive a list of certain disclosures we have made.
  • Restrictions. To request a limit on how we use or disclose your information. We are not required to agree, except that we must agree to withhold information from a health plan for a service you paid for in full out of pocket.
  • Confidential communications. To ask that we contact you at a particular phone number or address.
  • Paper copy. To receive a paper copy of this notice at any time.
  • Breach notification. To be notified if a breach of your unsecured protected health information occurs.
  • Choose someone to act for you. A personal representative with legal authority may exercise these rights on your behalf.

Changes to this notice

We may change this notice, and the changes will apply to all information we hold. The current version will always be posted on this page with its effective date.

Complaints

If you believe your privacy rights have been violated, you may contact us using the information below. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue SW, Washington, DC 20201, by calling 1-877-696-6775, or at hhs.gov/ocr/privacy/hipaa/complaints. You will not be retaliated against for filing a complaint.
